Contract Dispute
Settled before trial, with costs recovered.
Our client, a family-owned supplier, was facing termination of a distribution agreement on thirty days’ notice after eleven years of trading. The counterparty argued the agreement permitted it.
The contract did permit termination, but a course of dealing over a decade had created an expectation the court was willing to consider. We filed, obtained an injunction preserving supply, and negotiated an exit with a twelve-month transition and compensation.
